These terms are an agreement between you and StormDMCA. By creating an account you accept them. If you do not accept them, do not use the service. Anything you need from us goes through contact@stormdmca.com.
The service exists to protect adult creators, and you must be at least 18 years old to use it. We close accounts that are not.
We search public websites, Google Search and Google Images for copies of your content published without your permission. We show you what we find in this portal. On a paid plan we prepare and send takedown notices under the Digital Millennium Copyright Act (17 U.S.C. § 512) and equivalent laws, submit delisting requests to search engines, escalate to hosting providers and CDNs when a site does not respond, and re-check whether the content actually came down.
The free analysis is a one-off look at where your content is leaking. It does not include any takedown work.
This is the part that matters most, because we act in your name.
Filing a takedown notice for material you do not own is unlawful. Under 17 U.S.C. § 512(f) a person who knowingly misrepresents that material is infringing is liable for the damages that misrepresentation causes. If you direct us at content that is not yours, that liability is yours, and you agree to cover any claim, loss, or cost we incur as a result.
Before we file anything in your name you sign a separate Agent Agreement appointing us as your designated agent. That document governs what we are authorized to do on your behalf. We will not send a notice for you without it.
We pursue every removal diligently and we escalate when we are ignored, but the decision to remove content is made by the website, host, or search engine that receives our notice, not by us. Some operators are outside any jurisdiction that will enforce a takedown, and some simply refuse. We therefore cannot guarantee that any specific item will be removed, or removed within any particular time, and we do not promise that a removed item will not reappear. We tell you honestly what happened either way.
If you are a consumer in the EU or the UK you have a statutory right to withdraw from a distance contract within 14 days. Because the service starts immediately at your request, we may charge you for the work already done in that period.
Do not use the service to target content that is not yours, to harass anyone, to obtain information about another person, or to interfere with lawful publication. Do not try to break, overload, or reverse engineer the portal. We may suspend an account that does any of these, and we will tell you why.
How we handle your personal data, including the special category data involved in this service, is set out in our privacy notice. It forms part of these terms.
Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited, including any mandatory consumer protections that apply where you live. Subject to that, our total liability to you for any claim connected with the service is limited to the fees you paid us in the twelve months before the claim arose, and we are not liable for indirect or consequential loss, including lost income or reputational harm caused by content we could not get removed.
You can close your account at any time by writing to contact@stormdmca.com. We can end it if you breach these terms, if you direct us at content that is not yours, or if we stop offering the service, in which case we refund the unused part of your current month.
We may update these terms. If a change materially affects you we will email you before it takes effect, and continuing to use the service after that means you accept it. The date at the top always shows the current version.
These terms are governed by Italian law, and the competent Italian courts have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live, and you may also bring proceedings there.
